UFG imposes penalties for lack of third party liability insurance ppm after the expiry of the temporary 30-day vehicle registration!

Recently, my clients have been raising concerns that UFG is massively imposing fines for the lack of third party liability insurance ppm after the expiry of the temporary 30-day vehicle registration. In my opinion, such action is unjustified and the decision should be appealed.

1/ Pursuant to Art. Art. 29. 1.1. Compulsory Insurance Act, the Insurance Guarantee Fund and the Polish Motor Insurers' Bureau: "The vehicle owner is obliged to conclude a third party liability insurance contract for owners of motor vehicles: no later than on the day of registration of the motor vehicle... but no later than when the vehicle is put into service"

2/ Pursuant to Art. 74 section 2 point 1 and section 3 of the Road Traffic Law: "Temporary registration is made for a period not exceeding 30 days... After the expiry of the temporary registration period, the license plates are returned to the authority that issued them..."

In this state of affairs, it should be considered that temporary vehicle registration cannot be equated with vehicle registration referred to in Art. 72 uprd Moreover, after the expiry of the 30-day temporary registration of the vehicle, it should be assumed that the vehicle is not a registered vehicle, and therefore the vehicle owner is not obliged to insure third party liability insurance for motor vehicle owners.
