In the event of damaged goods, the easiest way is to retain the carrier's compensation. However, such action must have a solid legal basis.
I am pleased to inform you that the District Court in Lublin has awarded the carrier represented by Galicja Brokers several dozen thousand zlotys, along with statutory interest, from the forwarding company for unduly retained receivables for the transport of goods.
The freight forwarder withheld payments due to damage to the goods during unloading. During the investigation, we determined that:
✔️ the carrier is not liable for any damage caused,
✔️ the forwarder was not a creditor or a party entitled to set off the receivables.
It is once again confirmed that automatic detention of freight may result in the need to return the funds with interest.
