Under certain circumstances, the driver is personally and financially liable for the damage. Then the insurer is entitled to recourse to the driver for the compensation paid under the vehicle owner's liability insurance - art. 43 of the Act on Compulsory Insurance, UFG and PBUK.
Recourse to the driver occurs when he:
1. Willfully caused damage.
2. After using alcohol (from 0.2 per mille), drugs.
3. He fled the scene.
4. Came into possession of the vehicle as a result of a crime.
5. Lack of driving license.
6. No compulsory third party liability insurance - here the driver and the owner of the company are jointly and severally liable (UFG recourse).
As of today, drivers who have caused damage while driving after drinking alcohol have PLN 45-50 million to pay back to insurers.
