How should you pay for insurance policies so that the Insurance Company does not credit the payment towards old arrears - also those expired?
It often happens that the insured pays money to the account of Towarzystwo Ubezpieczeń (TU) without clearly indicating the number of the policy for which he is paying in the title of the transfer. Then the customer receives information from the insurance company that it has credited the payment to other - old unpaid policies. There may also be overdue arrearse, which means that we didn't have to pay for them at all (a statement about the limitation of claims is enough). The operation of TU is in accordance with art. 451 § 3 of the Civil Code
To avoid the above situation, the insured should clearly indicate in the title of the transfer what he is paying for, e.g. provide the policy number, invoice number, etc. Such a statement is binding for the creditor, who must credit the payment for this particular debt. The payment cannot be credited to the debtor's other liabilities. This is stated in Art. 451 § 1 of the Civil Code
This situation applies to insurance policy payments, but please note that crediting payments against the same type of debt applies to all commercial transactions in the market.
