THE VEHICLE OWNER'S TPL DOES NOT PROTECT AGAINST ENVIRONMENTAL DAMAGES, E.G. DUE TO A FUEL LEAK FROM THE CAR TANK!

According to Art. 38 sec. 1 point 4 of the Act of 22 May 2003 on compulsory insurance, UFG and PBUK, the insurance company is not liable for damages: consisting in pollution or contamination of the environment, e.g. when soil contamination occurs as a result of a diesel oil leak from a car tank. This means that the motor third party liability policy of the vehicle owner does not financially protect the carrier against such damage and he must repair it out of his own pocket.
The costs of removing, neutralizing or cleaning the soil of contaminants can reach tens or even hundreds of thousands of zlotys. These costs result from i.a. from the need to remove contaminated soil with vehicles intended for the transport of hazardous materials, filling the excavation with clean soil and microorganisms supporting the decomposition of petroleum substances, monitoring contamination by appropriate services, etc.
