Galicja Brokers – another victory in court!

Almost PLN 122,000 with statutory interest from February 2021 – this is what the Court of Appeal in Kraków awarded from the Insurance Company to the client of Galicja Brokers, whom I represented.

After more than four years of proceedings, the Court dismissed the appeal of the Insurance Company and upheld the judgment of the District Court in Kraków (9th Commercial Division) in its entirety.

The case concerned damage to four laser modules of a cutting machine – the insurer recognised only one module, refusing to pay for the remaining three, even though all of them lost power as a result of the damage.

An additional difficulty was the fact that the modules were covered by patents of the American manufacturer, which did not consent to their detailed examination.

The court confirmed that our client was right.
